Marc just signed a permanent contract elsewhere, feeling pretty good about it. Then he rereads his wage portage contract: a twelve-month non-compete clause, with no mention of compensation. Is it even valid? A lot of wage portage consultants only ask this question when they're already on their way out, often too late.
A non-compete clause in wage portage bars the employee from working for a competitor for a set period after their contract ends. To be valid, it has to be limited in time and geographic scope, target a genuinely competing activity, and above all include financial compensation paid to the employee. Without compensation, the clause is void, no matter how it's worded.
A non-compete clause is a provision in an employment contract that restricts an employee's freedom to work for a competitor or start a competing business after their contract ends. It protects the company, here the umbrella company or sometimes the end client, from the risk of a former employee using their know-how or client base for someone else's benefit.
This clause is never assumed. It has to appear explicitly, in writing, in the employment contract or in a signed amendment agreed by both parties. A verbal mention, or a clause buried in a document the employee never explicitly accepted, has no legal weight.
A non-compete clause is only valid if it meets five cumulative conditions: it protects a legitimate business interest, it's limited in time, it's limited in geographic scope, it accounts for the specifics of the employee's job, and it includes financial compensation. If even one condition is missing, a court can void the whole clause.

Under Article L. 1121-1 of the French Labour Code, still in force in 2026, a clause that places a disproportionate restriction on an employee's freedom to work can be struck down even if it includes compensation. Settled case law from the Cour de cassation's Social Chamber has applied these five criteria strictly since a landmark 2002 ruling, still the reference today.
Non-compete compensation is usually a percentage of the employee's average gross monthly salary, commonly between 25% and 50% depending on the applicable collective agreement. For a wage portage employee under the Syntec collective agreement, the typical rate runs around 25% to 33% of salary, paid monthly for the entire duration of the clause.
Compensation has to be proportionate to the constraint imposed. A very restrictive clause that keeps an employee from quickly finding work in their field, paired with token compensation, risks being reclassified by a labor tribunal as an abusive clause. So the amount is part of what determines whether the clause holds up, not just its existence.
An employee can challenge a non-compete clause by filing a claim with the labor tribunal if one of the five validity conditions is missing, most often insufficient or absent financial compensation. They can also negotiate a waiver directly with their former employer, which is often the faster route.
Some employers build in a clause letting them unilaterally waive the non-compete, usually within a set window after the termination notice. Once that window closes, compensation is still owed even if the employee never actually works for a competitor.
For a wage portage employee, the non-compete clause usually applies to the relationship with the umbrella company, rarely to the end client the assignment was carried out for. That distinction matters in practice: a consultant can often go back to work with the same end client through a different umbrella company without breaching their clause.
Still, it's worth reading the employment contract carefully before signing, especially in a niche field with few potential end clients. In that case, a poorly negotiated clause can seriously limit future opportunities, even if it's technically limited to the umbrella company.
