Freelance Definition: Status, Income and Pitfalls in 2026

Freelancer, self-employed, consultant, micro-entrepreneur: these words get used as if they meant the same thing, and they don't. Freelance isn't a legal status, it's a way of working. This page lays out the basics, then ties the theory to real numbers.

The short freelance definition: a freelancer works for several clients without being their employee, picks their assignments and sets their own rate. They run the business side themselves, or hand it to a structure such as wage portage, while staying in charge of their own clients.

The freelance definition in detail: who does it cover?

A freelancer is a professional who sells their skills to several clients without being an employee of any of them. They negotiate their own rate, often as a daily rate (the TJM), and organise their time alone. The word names neither a job nor a status: there are freelance developers, designers, writers and data consultants.

Where the word freelance comes from

The English phrase "free lance" described a mercenary whose lance belonged to no lord. Walter Scott popularised it in the 19th century in his novel Ivanhoe. It ended up describing any worker without a fixed employer.

Freelancer or self-employed: what's the difference?

French law has no "freelance" category. It has statuses: micro-entrepreneur, company manager, ported employee. A freelancer is a self-employed worker in the everyday sense, but some freelancers are employees (through portage) and some self-employed people aren't freelancers (a shopkeeper, for example). The nuance matters for social protection.

A freelancer can work as a micro-entreprise, through a company (SASU, EURL) or via wage portage. The right pick depends on your target revenue, the social protection you want and the time you're willing to give to admin. Each option moves the paperwork around, not the work you do for the client.

The micro-entreprise cap is set at €83,600 for services and liberal professions in 2026, according to service-public.gouv.fr. Going over it in a single year doesn't end the regime: you need to cross the threshold two years in a row. Our article on the 2026 micro-entreprise threshold covers the details.

A calculation says more than a threshold. At the median daily rate of €526 reported in the WEEPO Barometer 2026, €83,600 is reached after about 159 billed days. At twenty days a month, a full-time consultant therefore crosses the line around the eighth month of the year.

Freelancer versus employee: what really changes

Between a freelancer and an employee, the difference is subordination: an employee answers to an employer, a freelancer delivers a result to a client. The first gets a monthly salary, the second invoices assignments. Rights such as unemployment, paid leave and pension therefore vary a lot with the status you pick.

Here's what the freelancer gains in autonomy, and what they take on:

  • they choose their clients, hours and workplace, with no hierarchical pressure;
  • they must find their own assignments and live with uneven income;
  • they organise themselves to hit deadlines, invoice and chase late payments.

Freelancer and auto-entrepreneur: are they the same?

No. The auto-entreprise (now the micro-entreprise) is a simplified tax and social regime, whereas freelance describes a way of working. Many freelancers start as micro-entrepreneurs, then change setup once the business takes off. Our guide to becoming a freelancer in France walks through the first steps.

How many freelancers in France, and what do they earn?

No official source counts freelancers, but Insee records 4.4 million people running a business at the end of 2022. These self-employed workers make up 13% of total employment, and micro-entrepreneurs account for 49% of non-agricultural non-salaried workers, against 25% in 2013, according to Insee.

What does a freelancer earn? It depends on the trade and the status, and national averages blend very different profiles. For an IT consultant, the WEEPO Barometer 2026 (20,000 payslips of ported consultants) gives sharper benchmarks: a median daily rate of €526, with half of consultants between €450 and €600, for median revenue of €10,260 a month. What's left is going from revenue to net pay, which our article on converting a daily rate into net salary explains.

And for a consultant: why look at wage portage?

For a consultant or freelancer, wage portage keeps your commercial independence while making you an employee. You find your assignments and negotiate your daily rate, and the portage company invoices the client, pays your salary and handles contributions. It's one option among others, with trade-offs.

Take Sarah, a back-end developer leaving a permanent job. She negotiates €550 a day with an end client, without wanting to set up a company or run her own books. Under portage, she keeps a payslip and an employee's cover, at the price of management fees. At WEEPO, they're 3% capped at €550 per mission, plus 2% of additional fees (professional liability insurance, occupational health, factoring and financial guarantee, CVAE). The minimum accepted daily rate is €300 excl. VAT, and the "Zéro Frais Cachés" label, issued by the Fedep's, attests to cost transparency.

The freelance definition says nothing about the legal frame, and the frame is what changes your net pay. Working freelance without a company is therefore possible, but not free: handing admin to a third party has a cost, just as the time spent doing it yourself does. To compare on your own numbers, the net salary calculation under portage runs online in a few clicks. The WEEPO umbrella company then supports consultants who make that choice, and the page on wage portage for consultants explains how it works.

Torn between several statuses? Compare portage salarial or freelance side by side: social protection, admin, costs and autonomy are laid out together.

Frequently asked questions

What is a freelancer?

A freelancer is a worker who sells services to several clients without being an employee of any. They set their rate, choose their assignments and run their activity, alone or through a structure such as a company or wage portage.

French law doesn't define the freelancer as such. It provides statuses (micro-entrepreneur, company manager, ported employee) that a freelancer can choose depending on their situation.

Can you freelance without creating a company?

Yes, through wage portage: the portage company invoices your client and pays you a salary. You stay free to find your assignments, without registering a structure in your own name.

Which status should you choose to work freelance?

It depends on your revenue, your social protection and the time you give to admin. The micro-entreprise suits small volumes, a company suits higher income, and portage suits consultants who want employee status.

Is a freelancer an employee?

Not in principle: they invoice their clients and have no employer. Only a freelancer in wage portage is an employee, of the portage company, while staying free on assignments and rates.

Key takeaways

  • The freelance definition fits one sentence: a worker who sells services to several clients without being their employee.
  • Freelance describes a way of working, not a status: micro-entreprise, company and wage portage are the three main options.
  • The 2026 micro-entreprise cap is €83,600 for services, reached in about 159 billed days at €526.
  • Insee counts 4.4 million people running a business in France at the end of 2022.
  • For a consultant, wage portage keeps autonomy while providing employee status, in return for management fees.
