Lea has been a marketing consultant in wage portage for three years. She just landed a permanent job elsewhere and doesn't want to walk out overnight or get stuck with a dismissal on her record. Her question comes up constantly among "salaries portes": can you actually negotiate a mutual termination with your umbrella company, and how does it work in practice?
A mutual termination agreement in wage portage lets a consultant and their umbrella company end an open-ended employment contract by mutual agreement, in exchange for a payment at least equal to the statutory dismissal payment. The agreement then needs to be approved by the French labor administration. Unlike a resignation or a dismissal, neither side has to justify the decision.
A mutual termination (rupture conventionnelle) is a no-fault way to end an employment contract, governed by articles L.1237-11 to L.1237-16 of the French Labor Code, and it applies to permanent contracts, including those of wage-ported consultants. It doesn't apply to fixed-term wage portage assignments: those can only be ended early by mutual agreement under a different, less protective set of rules.
Wage-ported consultants are covered by the wage portage collective agreement (IDCC 3219), which sets a few practical details but largely defers to standard labor law for mutual terminations. In plain terms, your umbrella company is your employer here, so it's with them, not with the client company where your assignment takes place, that you negotiate.
Only a consultant on a permanent wage portage contract can request a mutual termination, and the agreement must be signed with the umbrella company, never with the client business, which isn't your legal employer. The request can come from either side, though in practice it's usually the consultant, often someone who has already found their next opportunity, as with Lea.
Two substantive conditions apply. First, free and informed consent from both parties: no pressure and no threats can weigh on the signature, or a labor court can later cancel the whole agreement. Second, at least one preliminary meeting where the consultant can be assisted by someone of their choosing from within the umbrella company or, if there's no staff representative body, by an outside adviser listed by the local prefecture.
The process runs through four main stages: a preliminary meeting, signing the agreement, a 15-calendar-day withdrawal period, and approval by the labor authority (DDETS) within 15 working days. Plan for roughly a month between the first conversation and the actual end of the contract, not counting any additional notice period you agree on.

This timeline is identical to any standard permanent employee's. What's specific to wage portage is mostly who you deal with: it's the umbrella company's HR team or management handling the file, not an operational manager at the client's premises.
The mutual termination payment can't be lower than the statutory dismissal payment, calculated from the consultant's average gross salary and their length of service with the umbrella company. Nothing stops the two parties from negotiating a higher amount if they agree.

On the tax and social security side, the payment is exempt from social contributions and income tax up to limits revised every year in the Social Security financing law. Above those caps, the excess portion is subject to standard contributions and CSG-CRDS.
A mutual termination gives you access to unemployment benefits (ARE) under the same conditions as a dismissal, provided you've been affiliated for at least 6 months over the past 24 months and register with France Travail.
