Sarah just found out she is pregnant with her second child. She has been a wage portage consultant for three years, and she has a simple question: does she get the same new birth leave that everyone has been talking about since July 2026, just like her partner on a standard permanent contract? The answer is yes, and the rules are exactly the same as for any other employee.
Birth leave in wage portage: since July 1, 2026, every wage portage employee who becomes a parent can take one to two extra months of leave, paid at 70 percent of net salary in the first month and 60 percent in the second, on top of maternity or paternity leave.
This new scheme adds to maternity and paternity leave, it does not replace them. For a wage portage consultant, the mechanics are identical to those of an employee on a standard permanent contract, with a few specifics tied to how portage works. Here is what you need to know before applying.
Birth leave is a new right created to strengthen the balance between work and family life, and to narrow the gap in leave taken by each parent after a birth. Each parent can take one or two extra months, right after maternity or paternity leave, or later within the months following the birth.
In practice, a wage portage employee who gives birth, or whose partner gives birth, can now combine standard maternity or paternity leave with this additional period. The measure mainly targets households where only one parent used to take real time off after a birth, often the mother, for lack of proper compensation for the other parent.
One point is worth clarifying right away: births that occurred between January 1 and June 30, 2026 also open this right. The usual nine month window to take the leave then runs from July 1, 2026, not from the birth date, which leaves until March 31, 2027 to use it.
A wage portage employee is eligible for birth leave under the same conditions as any other employee: being affiliated with Social Security, showing enough prior activity before the birth, and holding an active work contract (fixed term or permanent portage contract) at the time of the request.
This is where the wage portage status really shows its value. Unlike a self-employed contractor, who does not contribute to the general Social Security scheme the same way, a wage portage consultant is a full employee under French labor law (articles L. 1254-1 and following) and falls under the national collective bargaining agreement for wage portage (IDCC 3219). This gives the same rights as a permanent employee, with no extra step tied to the portage status itself.
| Situation | Eligible for birth leave |
|---|---|
| Permanent portage contract, continuous activity | Yes, no special condition |
| Fixed term portage contract, regular missions | Yes, if Social Security affiliation is sufficient |
| Between two missions, contract suspended | Check with the portage company, case by case |
| Self-employed work alongside portage | The right applies only through the portage contract |
A consultant who alternates between short missions should check one precise point with their portage company: whether the work contract stays continuous around the birth date. That continuity, more than the revenue actually invoiced, is what determines access to the leave.
Birth leave lasts one or two months per parent, on top of maternity leave (16 weeks for a first or second child) or paternity leave (25 calendar days). It can be taken right after these standard leaves, or later within the year following the birth, according to the rules set by the Ministry of Labor.
For a wage portage employee, the request follows the same process as any parental leave: written notice to the employer, here the portage company, with a notice period to respect. Except that the employer, in this specific case, already handles all the administrative steps tied to the payslip and the nominative social declaration, which takes a lot of the paperwork off the consultant's plate.
In practice, it is best to notify the portage company as soon as the pregnancy is confirmed or as soon as the birth date is known. Some portage companies ask for a month's notice before the leave starts, others are more flexible. An email is usually enough, along with a medical certificate or the birth certificate once the child is born.
During birth leave, pay amounts to 70 percent of the usual net salary in the first month, then 60 percent in the second month, paid by Social Security under the terms set by the reform that took effect in July 2026.
This level of pay is calculated on the average of the last three payslips, exactly as for maternity or paternity daily allowances. This matters for a wage portage consultant whose pay can vary from month to month depending on the day rate invoiced: the more the salary has been smoothed in the preceding months, the more favorable and predictable the calculation of the allowance.
For comparison, the daily maternity leave allowance stays capped at 104.02 euros gross per day in 2026, a cap set by the French health insurance system and identical for every employee, portage or not. The portage company sometimes tops up this amount depending on internal agreements or the welfare policy in place, a point worth checking when choosing a portage company.
Three schemes now coexist, and confusion is common. Maternity leave applies to the mother, lasts 16 weeks for the first two children and longer from the third child onward. Paternity and childcare leave lasts 25 calendar days, open to the second parent regardless of their relationship to the child. Birth leave adds to both of the above: each parent can use it separately, for one or two extra months.
A wage portage consultant can therefore, in theory, take paternity leave followed by birth leave, bringing the total time off to nearly three months for the second parent. This is a notable change from the situation before July 2026, where the gap between the two parents often stayed quite wide.
No. It is a right, not an obligation. The wage portage consultant chooses whether to take it, in full or in part, based on personal circumstances and ongoing missions.
The exact rules on splitting the leave depend on the implementing texts of the reform. In most documented cases so far, the leave is taken in one continuous period, right after maternity or paternity leave, or deferred within the year following the birth.
No, the financial reserve built up by the portage company is not affected by taking this leave. It stays available to cover any periods without a mission, regardless of parental leave taken.
What mainly matters is a sufficient period of Social Security affiliation before the expected birth date, generally several months of activity. A consultant who just signed their first portage contract should check this point precisely with their portage company.
Yes, as long as the Social Security affiliation conditions are met. The type of work contract, fixed term or permanent portage contract, does not change access to birth leave.
