Sick Leave Waiting Days in France: Who Pays in 2026

You fall ill on a Tuesday, your doctor signs you off, and this month's pay comes in lighter than planned. The culprit has a name: waiting days.

The waiting day (jour de carence) is the first stretch of a sick leave that social security doesn't pay: 3 days for a private-sector employee or a self-employed worker, 1 day for a civil servant. Your employer may cover part of the gap, depending on your seniority and your collective agreement.

Sick leave waiting days in France: the 3-day rule in 2026

The waiting period is the start of a sick leave during which health insurance pays no daily allowance. For a private-sector employee, payments only begin after 3 waiting days, and the delay applies to every new leave, according to service-public.gouv.fr. A one- or two-day leave therefore earns you nothing from social security.

Three waiting days for a one-day sick leave: how it works

An example beats a definition. An employee is off for 5 days: social security only pays for days 4 and 5. The first three are on them, unless the employer tops up.

What about a one-day leave? Nothing is paid either. Is a single sick day paid anyway? That depends on your employer and your collective agreement, never on social security.

How to avoid losing the waiting days

The delay doesn't apply if you go back to work for less than 48 hours between two leaves, nor to successive leaves linked to a long-term condition. After a work accident or an occupational disease, the employer's top-up starts on day one. Outside these cases, the only fix is a collective-agreement guarantee or private cover.

How many waiting days depending on your status?

The number of waiting days depends on your status: 3 days for a private-sector employee, 1 day for a civil servant, 3 days for a self-employed worker. Only employees can count on an employer top-up. The table compares the rules in force in 2026.

StatusSocial security waiting periodWhat compensatesSource
Private-sector employee3 daysEmployer: 90% of gross pay from day 8, with 1 year of seniority, unless the agreement is more generousService-public (sheet F3053)
Civil servant1 unpaid daySalary kept at 90% for 3 months, then half for 9 monthsService-public (sheet F13861)
Self-employed worker3 days, payment from day 4No employer: daily allowance of up to 65.84 € (general self-employed scheme)Meilleurtaux, Moneyvox

The private-sector waiting day applies to every employee, IT executives included. The rest depends on what you signed.

Waiting day in the civil service: 1 day in 2026

In the civil service, the waiting day is an unpaid day: staff are paid from the second day of sick leave, according to the service-public.gouv.fr sheet checked on 3 August 2026. Moving to 3 days was debated during the 2026 budget, but the published rule remains one day.

Salary continuation: who pays the waiting days?

Your employer only pays the missing days if the law or your collective agreement requires it. The law provides salary continuation from day 8 of the leave, provided you have one year of seniority in the company and hand in the medical certificate within 48 hours.

Who has 7 waiting days? That's the employer side: without a more generous agreement, the employer's own waiting period is 7 days. The top-up then reaches 90% of gross pay for 30 to 90 days depending on seniority, then 66.66% for another 30 to 90 days.

How social security daily allowances are calculated

The allowance equals 50% of the basic daily wage, meaning the last 3 gross salaries added up and divided by 91.25. The salary used is capped at 1.4 times the minimum wage, or 2,613.82 € a month in 2026, and the allowance can't exceed 42.97 € gross a day.

An executive on 4,500 € gross a month earns about 150 € gross a day. During the leave, social security pays 42.97 € at most. The employer's top-up bridges the gap, or doesn't.

Syntec waiting days: what the IT services agreement says

In an IT services firm covered by the Syntec agreement, no employer waiting period applies, according to Juritravail: pay continues from the first day of absence, after one year of seniority. Executives get 100% of gross pay for up to 90 days over 12 months. Check the exact wording of your agreement before relying on it.

Waiting days for freelancers: self-employed, SASU or wage portage

A self-employed freelancer also faces 3 waiting days, but with no employer to compensate, and the allowance is capped at 65.84 € a day under the general self-employed scheme. A consultant torn between statuses should compare sick-leave protection as much as net income.

Self-employed waiting days: what social security pays

A self-employed worker's allowance starts on day 4 and requires 12 months of affiliation, according to Meilleurtaux. Liberal professions under the CNAVPL can reach about 197.50 € a day per Previssima, but only up to day 90. The Cipav and its protection rules pay nothing beyond that. For a micro-entrepreneur, the fund uses turnover after the flat-rate allowance.

The maths at the median day rate

Take a consultant billing 526 € a day, the median day rate in the WEEPO Barometer 2026 (20,000 payslips of portage consultants). Every sick day is an unbilled day: 3 waiting days already mean 1,578 € less turnover. The maximum allowance of 65.84 € covers 12.5% of a billed day. The gap gets filled with private cover or a cash buffer, rarely with social security.

Wage portage waiting days: an employee, so the general scheme

A portage consultant is an employee of the portage company. They fall under the employee scheme: 3 waiting days on the social security side, then the continuation set by the collective agreement (IDCC 3219) and their contract. Only seniority with your own portage company counts, even if median seniority in portage reaches 29 months (WEEPO Barometer 2026). Our guide on sick leave in wage portage covers the steps, and the one on the portage collective agreement covers the guarantees.

Frequently asked questions

What are the 3 waiting days?

They're the first three days of a sick leave for which social security pays no allowance, for a private-sector employee as for a self-employed worker. Payments start on day 4.

How many waiting days in 2026?

3 days for a private-sector employee and a self-employed worker, 1 day for a civil servant. An employer can add its own 7-day delay before topping up pay, unless the agreement is more generous.

How can you avoid losing 3 waiting days?

Go back to work for less than 48 hours between two leaves, or have successive leaves tied to a long-term condition. Otherwise only a generous agreement or private cover fills the three days.

Does a freelancer have waiting days?

Yes, 3 days, and nobody compensates. A consultant in wage portage is an employee: the same social security delay applies, but salary continuation set by the agreement and the contract kicks in.

Is one day of sick leave paid?

Social security pays nothing for a one-day leave. Only the employer can pay it, if your collective agreement removes its waiting period, as the Syntec agreement does.
